This Privacy Policy explains how we collect, use and disclose your personal information when you visit or use the Services, make a purchase or other transaction through them, or otherwise communicate with us.

If there is any conflict between our Terms of Service and this Privacy Policy, this Privacy Policy will apply in relation to the collection, processing and disclosure of your personal information.

Please read this Privacy Policy carefully. By accessing or using any of the Services, you acknowledge that you have read this Privacy Policy and understand how your information is collected, used and disclosed as described below.

Personal information we collect or process

When we use the term “personal information”, we mean information that identifies you or can reasonably be linked to you or another person.

Personal information does not include information that has been collected anonymously or de-identified so that it cannot reasonably identify or be linked to you.

Depending on how you interact with the Services, where you live, and as permitted or required by applicable law, we may collect or process the following categories of personal information:

  • Contact details, including your name, address, billing address, shipping address, phone number and email address.
  • Financial information, including credit or debit card details, financial account information, payment-card information, transaction details, payment method, payment confirmation and other payment details.
  • Account information, including username, password, security questions, preferences and settings.
  • Transaction information, including products you view, add to your cart or wishlist, purchase, return, exchange or cancel, as well as previous transactions.
  • Communications with us, including information you provide when contacting customer service.
  • Device information, including information about your device, browser, network connection, IP address and other unique identifiers.
  • Usage information, including information about how and when you interact with or navigate the Services.

Sources of personal information

We may collect personal information:

  • directly from you when you create an account, use the Services, communicate with us or otherwise provide information;
  • automatically through the Services, your device, cookies and similar technologies;
  • from service providers that provide technology or process information on our behalf; and
  • from business partners or other third parties.

How we use your personal information

We may use personal information for the following purposes:

  • Providing, personalising and improving the Services. This includes processing payments and orders, remembering preferences, managing accounts, arranging delivery, facilitating returns and exchanges, enabling reviews and providing product recommendations.
  • Marketing and advertising. We may use your information to send marketing or promotional communications and to display relevant advertising.
  • Security and fraud prevention. We may use information to verify accounts, secure checkout, detect or investigate fraudulent or unlawful activity and protect the Services.
  • Communicating with you. We use information to provide customer support and respond to enquiries.
  • Legal purposes. We may use information to comply with applicable law, respond to valid legal processes, resolve disputes, enforce our policies and investigate potential violations.

How we disclose personal information

In certain circumstances, we may disclose personal information to third parties for legitimate purposes consistent with this Privacy Policy, including:

  • Shopify and other service providers that support IT, payment processing, analytics, customer support, cloud storage, order fulfilment and shipping;
  • business and marketing partners;
  • third parties where you direct, request or consent to disclosure;
  • our affiliates or companies within our corporate group; and
  • parties involved in a business transaction or where disclosure is required to comply with legal obligations, enforce our terms or protect our rights, users or Services.

Relationship with Shopify

Shopify hosts the Services and collects and processes personal information about your access to and use of the Services in order to provide and improve them.

Information you provide through the Services may be transferred to and shared with Shopify and other third parties that may be located outside your country of residence.

For more information about how Shopify uses personal information, please review the Shopify Consumer Privacy Policy and the Shopify Privacy Portal.

Third-party websites and links

The Services may contain links to websites or online platforms operated by third parties.

If you follow a link to a website that is not affiliated with us or under our control, you should review that website’s privacy, security and other terms.

We do not guarantee and are not responsible for the privacy, security, accuracy, completeness or reliability of third-party websites or platforms.

Children’s data

The Services are for adult customers, including parents and legal guardians, and are not intended for children to register or shop independently. Where our optional Birthday Club is available, parents or legal guardians may knowingly provide limited information about a child, including a nickname, date of birth, optional interests and consent, to administer the service. We process this parent-provided information for the stated Birthday Club purposes rather than asking children to submit their details directly.

If you are the parent or guardian of a child who has provided personal information to us, you may contact us using the details below to request deletion.

As of the effective date of this Privacy Policy, we do not have actual knowledge that we “share” or “sell”, as those terms may be defined by applicable law, personal information of individuals under 16 years of age.

Security and retention of your information

No security measure is perfect or completely impenetrable, and we cannot guarantee absolute security.

Information sent to us may not always be secure while in transit. We recommend that you do not use unsecured channels to send sensitive or confidential information.

The length of time we retain personal information depends on factors such as whether it is needed to maintain your account, provide Services, comply with legal obligations, resolve disputes or enforce agreements and policies.

Your rights and choices

Depending on where you live, you may have some or all of the following rights:

  • Right to access or know the personal information we hold about you.
  • Right to deletion of personal information we hold about you.
  • Right to correction of inaccurate personal information.
  • Right to data portability, including receiving a copy of personal information and, where applicable, requesting its transfer to another party.
  • Managing communication preferences. You may unsubscribe from promotional emails at any time using the unsubscribe option in those messages. We may still send non-promotional communications relating to your account or orders.

You may exercise available rights through the Services where indicated or by contacting us using the details below.

We may need to verify your identity before processing a request, as permitted or required by applicable law.

Where permitted, you may appoint an authorised agent to submit a request on your behalf.

Complaints

If you have a complaint about how we process your personal information, please contact us using the details below.

Depending on where you live, you may also have the right to appeal a decision or submit a complaint to your local data-protection authority.

International transfers

We may transfer, store and process your personal information outside the country where you live.

Where required by applicable law, we will use recognised transfer mechanisms or appropriate safeguards for international transfers.

Changes to this Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to our practices or for operational, legal or regulatory reasons.

We will publish the revised Privacy Policy on this website, update the “Last updated” date and provide notice where required by applicable law.

ELC Toys Mobile App, Birthday Club and Account Deletion

The ELC Toys mobile app serves separate Shopify stores for Saudi Arabia, the UAE, Bahrain and Qatar. This Saudi Privacy Policy applies to the Saudi store, elctoysksa.com; country-specific customer accounts, prices and orders remain separate.

App information. To provide Shopify account sign-in, shopping, wishlists, order access, language preferences and necessary app functions, we may process your customer identifier and email, country and language setting, saved product identifiers, app activity, push-notification device token and notification preferences. Technical processors operate necessary services. Promotional and optional Birthday Club push messages follow the applicable consent and preference settings; allowing device push permission alone is not marketing consent.

Parent-operated Birthday Club. Where offered, the parent or legal guardian provides a child nickname, birth date, optional interests and parental consent for reminders, gift suggestions, eligibility verification and any available one-time Birthday Gift. When a gift is issued or redeemed, limited entitlement and claim records may be needed to prevent a duplicate claim.

Child-profile deletion. A parent may remove any registered child, including an already verified or previously gifted child, within Birthday Club in the mobile app. The child's visible nickname, birthday and interests are cleared, and future reminders stop. Where justified, restricted historical gift issuance/redemption records and pseudonymous eligibility references may be retained to enforce the one-time gift rule; they can remain personal information while linkable to a person and are not used for marketing. Retention need is reviewed at least every 12 months and records are erased or irreversibly de-linked when no longer justified, subject to applicable law.

Full-account deletion. Adult customers may initiate deletion for the Saudi Shopify account and associated app data, or request that other participating country accounts also be considered, using the secure account-deletion form even when the app is uninstalled. Use the private reference checker to see request progress. We verify ownership separately for each requested store before processing relevant Shopify customer records, app profiles, wishlists, push-device identifiers and child profiles where applicable. Some order, tax, accounting, claims and proportionate anti-fraud records may lawfully need retention. Submitting a request is not instant erasure; we confirm only after processing is complete.

Retention, international processing and rights. Records are used and retained only for disclosed functions, legal obligations and justified security or dispute needs, subject to the rights and cross-border safeguards described in this policy and applicable Saudi requirements. Parents can seek child information access, correction and deletion as permitted by law.
